These Terms of Service ("Terms") govern your access to and use of Tov Pocket (https://tovpocket.com), a family activity and discount marketplace operated by MITP5787, Inc., a Florida corporation ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using Tov Pocket in any way, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

2. Description of Service

Tov Pocket is a directory and coupon platform, free for consumers, with optional paid listing and advertising products for businesses. It connects observant Jewish families to local activities, kosher restaurants, Jewish-owned businesses, and exclusive discount coupons, all year round. We facilitate connections between families and the venues and businesses listed; we do not operate or guarantee the availability of any venue, business, activity, or offer listed on the platform.

3. Accounts

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • One account per individual user.
  • You must notify us immediately at support@tovpocket.com if you suspect unauthorized use of your account.
  • You may register with either a GMAIL email account or a telephone number.
  • No email addresses or mobile information will be shared with third parties/affiliates for marketing or promotional purposes.
  • SMS messages are used to share coupon information and you can opt out at anytime by replying with STOP.
  • Customers visit our public website and enter their mobile phone number into a web form to receive a single one-time discount coupon code via SMS. Messaging is strictly transactional and user-initiated upon form submission. We do not send recurring marketing blasts or share opt-in data with third parties.

4. Coupon Terms

4.1 Availability. Discount coupons are available while supplies last. Each venue may have a limited number of coupons available. Tov Pocket does not guarantee coupon availability.

4.2 Redemption. Coupons must be redeemed at the participating venue during the specified period. Tov Pocket is not responsible for a venue's refusal to honor a coupon.

4.3 Non-Transferable. Coupons issued to your account are for personal, non-commercial use only and may not be resold, transferred, or used by others.

4.4 No Cash Value. Coupons have no cash value and cannot be exchanged for cash or credit.

5. Intellectual Property

All content on Tov Pocket — including descriptions, logos, and software — is owned by or licensed to MITP5787, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

6. User Reviews

By submitting a review, you grant MITP5787, Inc. a non-exclusive, worldwide, royalty-free license to display that review on the platform. You agree that your review is truthful, based on your genuine experience, and does not violate any third-party rights.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to any part of the Service.
  • Submit false, misleading, or fraudulent reviews or information.
  • Misrepresent your identity or affiliation.
  • Introduce malware, viruses, or other harmful code.

We reserve the right to suspend or terminate accounts that violate these rules.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. MITP5787, INC. MAKES NO WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY VENUE LISTING IS ACCURATE OR UP TO DATE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MITP5787, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY VENUE VISITED THROUGH THE PLATFORM.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions. Any dispute shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updates constitutes your acceptance of the changes.
